Zoning & Construction Information


 

 Zoning Administration: A zoning certificate is required anytime any vacant land is occupied or used, occupying a structure that has been constructed, reconstructed, moved, altered or enlarged. A certificate is also required when the use of a structure of land to a different use or the changing to a non-conforming use. Examples of when a Zoning Certificate is required and this list are not inclusive: 

  1. Sheds, garages or other accessory structures separate from the main dwelling
  2. Additions, renovations, demolitions of any structure on the property
  3. Additional parking, driveways, sidewalks, etc.
  4. Fencing and other shielding effects 

Recently, there has been a few "PODS" seen around town which are used for storage. These are considered a temporary non-conforming structure and require a zoning certificate good for six months. The certificate may be extended by an additional six months but no more. 

Please call the Borough Hall with any questions you may have concerning your projects. 

Zoning Permit Procedure:  Application for permit MUST BE MADE at the North East Borough Office and include the following:

  1. Completely fill out the Zoning Application which includes the following items;
    a.  Plot drawing (1”=50’ scale) of structure located on the property with size and locating dimensions
    b. 
    Builder’s workers compensation insurance certificate or notarized exemption form
    c.  Stormwater Management Worksheet(s)
    d. 
    Permit fee (as listed below)
    e. 
    Sewer/ Septic permit, if applicable
    f. 
    Driveway permit for new residence located on a state road
  2. Property must be staked
  3. Drop off package at Borough Hall
  4. Zoning Officer will contact resident and visit property
  5. Zoning Officer will approve or disapprove application in accordance with Zoning Ordinance and other applicable Borough Ordinances

Please note that these items must be completed AT THE TIME OF APPLICATION. Incomplete applications will not be accepted.  The zoning permit will be mailed to the applicant upon approval. The entire process takes approximately three (3) working days.  

Building/Construction Permit Procedure:  Building permits and the Uniform Construction Code administrator for North East Borough is handled through the North East Area Code Administration.  Our building codes official is:

Driveway and Sidewalk Permit Procedure**

North East Borough residents, businesses and/or organizations will be required to obtain a permit for the following due to the American Disabilities Act and Stormwater Management requirements:

  1. the installation and/or replacement of a driveway
  2. the installation and /or replacement of a sidewalk
  3. any pipe or drainage installation or other storm sewer work

Permits may be obtained at the North East Borough Hall, Monday through Friday, 8:00 AM to 4:30 PM. 

NO FEE WILL BE ASSESSED FOR DRIVEWAY APRON OR SIDEWALK PERMITS 

**MAY REQUIRE A STORMWATER MANAGEMENT PLAN: current ordinances allow exemptions for residential projects <5,000 square feet.  All projects shall complete a stormwater management worksheet with projects imposing over 5000 square feet of impervious surface shall require a stormwater management plan.
